Apartments completed before RERA now eligible for registration in Odisha

Bhubaneswar, Feb 1: The Odisha government has announced that apartments completed before the implementation of the Real Estate (Regulation and Development) Act (RERA) can now be registered by authorities.
In a notification released on Saturday, the Urban and Housing Development Department clarified that Registration Authorities must not deny the registration of any apartment based on the provisions of the Odisha Apartment (Ownership and Management) Act (OAOM) if it was finished before RERA came into effect on February 25, 2017.
The department has instructed the Revenue and Disaster Management department to guide Registration Officers in facilitating the registration of these apartments. The OAOM Act, which became effective on June 28, 2023, aims to streamline regulations concerning apartment ownership and management and is aligned with RERA's provisions.
This recent clarification resolves previous uncertainties regarding the OAOM Act and RERA, enabling apartment owners to proceed with the registration of sale and transfer deeds. In November 2024, the government also announced initiatives to enhance the registration process for common areas in apartments and address pre-RERA project registrations to safeguard home buyers' interests.
